Qualified tips are voluntary — cash tips and credit card tips left at the customer's discretion. Non-qualified tips are mandatory service charges like auto-gratuity on large parties or banquet fees. Only qualified tips are deductible under OBBBA.
Yes. OBBBA compliance is federal. Every employer in all 50 states must report qualified tips and OT premiums on federal W-2s. Non-conforming states (like CA and NY) just means employees won't get the deduction on their state tax return.
